Decision:

1. That the security Bond be released as set out under the “Terms” contained in the related Part 2 report.

 

2. That the Corporate Director, Placein consultation with the Corporate Director, Governance and Community Strategy, be given delegated authority to finalise the terms for the release of the Bond; and that the Corporate Director, Governance and Community Strategy be authorised to take all necessary steps which will allow for the release of the Bond in accordance with the terms agreed.

Reasons for the decision:

To secure approval for the release of the security Bond will conclude the outstanding property matter in respect of the Hale Barns Shopping Centre CPO, and in the interests of avoidance of future action being taken against the Council for unnecessary retention of the security Bond.

Alternative options considered:

Do nothing, in which case the Developer could potentially bring a claim against the Council on the basis that retaining a security Bond is unreasonable given the background and the payments already made of the Council’s costs incurred in connection with the scheme.
