Decision:

1. That the Council on the basis of the available evidence and for the reasons set out in the report does not make an Order to upgrade the route referred to in the report on the Definitive Map and Statement as a Bridleway.

2. That the applicant and landowners be notified in writing of the decision, and that there is a right of appeal procedure to the Secretary of State for a review of the decision.

Reasons for the decision:

To determine an application made to Trafford Council to upgrade a public footpath to a public bridleway on the Definitive Map and Statement under s53(2) Wildlife and Countryside Act 1981.

Alternative options considered:

An option that the Corporate Director, Governance and Community Strategy be authorised to make and advertise a Modification Order under s53(2)(b) of the Wildlife and Countryside Act 1981 to modify the Definitive Map and Statement to upgrade the public footpath to a public bridleway was considered but this option is not recommended as it is considered that it would not be in accordance with the interpretation of the relevant guidance and legislation following analysis of available evidence.
