Minutes:

RESOLVED: That the minutes of the Public Protection Sub-Committee meeting held on 19th January 2017 be approved as a correct record and signed by the Chairman.

EXCLUSION RESOLUTION (REMAINING ITEMS)

Motion (Which may be amended as Members think fit):

 

That the public be excluded from this meeting during consideration of the remaining items on the agenda, because of the likelihood of disclosure of “exempt information” which falls within one or more descriptive category or categories of the Local Government Act 1972, Schedule 12A, as amended by The Local Government (Access to Information) (Variation) Order 2006, and specified on the agenda item or report relating to each such item respectively.

Minutes:

RESOLVED: That the public be excluded from this meeting during consideration of the following items on the agenda because of the likelihood of disclosure of “exempt information” which falls within one or more descriptive category or categories of the Local Government Act 1972, Schedule 12A, as specified.

PRIVATE HIRE DRIVER - CONVICTION WHICH EXCEEDS THE SCHEME OF DELEGATION

To consider a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report requesting Members to consider a conviction received by a Trafford licensed private hire driver.

 

The driver attended the meeting to enable Members to give the matter their full consideration.

 

The driver provided the Sub-Committee with an outline of what he said were the circumstances of the offence.

 

The driver also answered questions directed to him from Sub-Committee Members.

 

The Sub-Committee considered his record of driving a private hire vehicle while licensed by Trafford.

 

            RESOLVED: That no further action be taken against Mr. T. M.

PRIVATE HIRE DRIVERS APPLICATION - APPLICANT PREVIOUSLY REVOKED ON GROUNDS OF FITNESS

To consider a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report requesting Members to consider an application for the grant of a Private Hire driver’s licence.

 

The applicant attended the meeting to enable Members to give the matter their full consideration.

 

The applicant provided the Sub-Committee with an outline of his situation since the revocation of his previous licence.

 

The driver also answered questions directed to him from Sub-Committee Members.

 

The Sub-Committee considered that he had a Private Hire driver’s licence revoked previously and the reasons for that revocation.

 

The Sub-Committee considered that he accepted the allegations made against him as he had done in 2014.  The applicant expressed remorse and said it would not happen again, a representative of Scotts Taxis and his father expressed their faith that he would not repeat the actions which led to the revocation.

 

The Sub-Committee sought evidence of a sustained period of time during which he had not repeated the behaviour which led to the complaints and revocation.  The Sub-Committee were unable to find the requistite evidence that would enable them to determine that he no longer posed any threat to the public.

 

            RESOLVED: That Mr. B. H’s application be refused.
