The Head of Public Protection submitted a report informing Members of a request from Greater Manchester Police for a review of an existing premises licence.

 

Representations were made by PC Parkin representing Greater Manchester Police.

 

Representations were also made by Mr O. Parto Premises Licence Holder of Canada Grill, 38 Railway Street, Altrincham, WA14 2RE and Mr D Mousavi, Manager of Canada Grill.

 

RESOLVED –

 

(1)          That the existing Premises Licence be continued subject to an additional condition as outlined in the decision notice below.

 

(2)          That the issue of the licence be delegated to the Head of Public Protection.

LICENSING SUB-COMMITTEE DECISION

 

 

  1. The application for a review is from a responsible authority, namely Greater Manchester Police and is a valid application in that it refers to the Premises Licence Holder not abiding by the current licensable activities and the licence conditions on a number of occasions and relates to the licensing objectives; the prevention of crime and disorder, public safety and the prevention of public nuisance.

 

  1. That a further condition be attached to the licence that a SIA door person is employed on the premises between the hours of midnight and 3.00am on Fridays and Saturdays.

 

 

LICENSING SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION

 

  1. The Sub Committee had regard to the Licensing Act 2003 and regulations; the Secretary of State’s Guidance and the Council’s Licensing Policy.

 

  1.  The Sub Committee carefully considered the evidence from Greater Manchester Police as well as representations at the hearing by the Premises Licence Holder.

 

  1. The Sub-Committee believe that the additional condition is appropriate and proportionate to the promotion of the licensing objectives.

RESOLVED: That this item be withdrawn from the agenda as Greater Manchester Police withdrew their objection to the transfer of the premises licence.
