To consider a report of the Head of Public Protection. Minutes: Further to Minute No. 5 of the meeting held on 3 April 2014, the Sub-Committee reconvened to consider an application received from Rontec Watford Limited for the grant of a Variation of Premises Licence for Crossings Service Station, 16 Stockport Road, Altrincham which had attracted representations from a local resident.
All parties present at the hearing were invited to address the Sub-Committee.
Representations were made in support of the application by Ms. S. Calder, Solicitor on behalf of the Applicant and by Mr. D. Roberts, Area Manager, Rontec. Representations were made against the application by Mr. M. Carroll, local resident.
RESOLVED –
(1) That the application by Rontec Watford Limited for a Variation of a Premises Licence for Crossings Service Station, 16 Stockport Road, Altrincham be granted, as set out in the decision notice below.
(2) That the issue of the Licence be delegated to the Head of Public Protection.

LICENSING SUB-COMMITTEE DECISION
The Sub-Committee decided that the representation from a local resident relating to public nuisance was a relevant representation from an interested party living in the vicinity of the premises.
To grant a variation of the premises licence to extend the hours of licensable activity of the sale of alcohol to 24 hours daily.
LICENSING SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION
1. The Sub-Committee carefully considered the resident’s concerns regarding the potential for noise nuisance and balanced those concerns with the interests of the applicant and the licensing objectives.
2. The Sub-Committee considered that the existing conditions are relevant, necessary, proportionate and in pursuance of the licensing condition, the prevention of public nuisance.
3. The Sub-Committee also noted that local residents and responsible authorities could request a review of the premises licence, should there be a breach of conditions.
4. The Sub-Committee also noted that the applicant was willing to discuss with the representor the possibility of providing cones to cordon off the area to the rear of the building. This could be done in conjunction with closure of the shop doors. |
