Application to vary a premises licence under S34 of the Licensing Act 2003 - Carters Arms, 367 Northenden Road, Sale M33 2PG

The Head of Regulatory Services submitted a report requesting Members to consider an application for a variation of the premises licence for Carters Arms, 367 Northenden Road, Sale, M33 2PG which had attracted representations from local residents and Pollution Control, Trafford Council.

 

All parties present at the hearing were invited to address the Sub-Committee.

 

Representations were made on behalf of the applicant by Mr. Robson, Associate John Gaunt & Partners and against the application by a local resident and Councillor Patel.

 

RESOLVED –

 

(1)             That the application by John Gaunt & Partners on behalf of Marston’s PLC for the grant of a variation to the premises licence for Carters Arms, 367 Northenden Road, Sale, M33 2PG be granted, subject to compliance with the conditions outlined in the decision notice.

 

(2)          That the issue of the licence be delegated to the Head of Regulatory Services.

LICENSING SUB-COMMITTEE DECISION

 

The Sub-Committee decided that the representations received from Local Residents are relevant / are not relevant representations.

 

To grant a variation of the premises licence as follows:

 

Amendment of existing condition:

 

“Use of beer garden or outside area should not be permitted beyond 21:00 or dusk (whichever is sooner)”

 

to

 

“Customers shall not be permitted to use the beer garden / outside area beyond 21:00 except for the purposes of smoking, however, no food or drink shall be taken into the area after 21:00”

 

 

Additional Conditions

 

CCTV signs be clearly placed in the outside area and bar area where they can beeasily seen and read.

 

Signs to be placed to notify that any drinks or food shall not be consumed in the outside area after 21:00.

 

That smoking by customers in the outside area is restricted to the patio, as per the agreed attached plan, after 21:00.
