To consider a report of the Head of Public Protection.

 

Minutes:

The Head of Public Protection submitted a report informing Members of an application received from Shell UK Oil Products Limited for the grant of a premises licence for Shell Ringway, Timperley, which had attracted representations from local residents.

 

All parties present at the hearing were invited to address the Sub-Committee.

 

Representations were made in support of the application by Mr. B. Holland, Solicitor on behalf of the applicant, Mr. C. Lockett, the Licensing Agent and Mr. U Mahmood, the Designated Premises Supervisor. 

 

           RESOLVED –

 

(1)       That the application by Shell UK Oil Products Limited for a Premises Licence for Shell Ringway, 155 Stockport Road, Timperley, be granted, subject to compliance with the conditions outlined in the decision notice.

 

(2)       That the issue of the Licence be delegated to the Head of Public Protection.

LICENSING SUB-COMMITTEE DECISION

 

The Sub-Committee decided that the representations from local residents were from interested parties living in the vicinity of the premises.

 

The Sub-Committee decided that those representations relating to the Prevention of Public Nuisance and Protection of Children from Harm were relevant representations.

 

To grant a premises licence as follows:

       Monday to Sunday                07.00 hrs to 23.00 hrs

 

Conditions

LICENSING SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION

 

The Sub-Committee considered the Licensing Act 2003 and regulations, the Guidance and the Council’s Licensing Policy, the application and all representations made.

 

The Sub-Committee considered all the written representations received from local residents.

 

The Sub-Committee considered whether the premises classification fell into the category of a petrol station or a convenience store.  They were satisfied that it is a convenience store based on sales and product strategy.

 

The Sub-Committee considered the staffing levels and the premises’ ability to manage an increase in demand.

 

The Sub-Committee noted that the measures outlined were comprehensive and dealt with the concerns and that they were a large reputable company with policies, procedures and training already in place.

 

The Sub-Committee carefully considered the resident’s concerns regarding the potential for Public Nuisance and potential harm to children from and balanced those concerns with the interests of the applicant and the licensing objectives.
