EXCLUSION RESOLUTION (REMAINING ITEMS)

Motion (Which may be amended as Members think fit):

 

That the public be excluded from this meeting during consideration of the remaining items on the agenda, because of the likelihood of disclosure of “exempt information” which falls within one or more descriptive category or categories of the Local Government Act 1972, Schedule 12A, as amended by The Local Government (Access to Information) (Variation) Order 2006, and specified on the agenda item or report relating to each such item respectively.

RESOLVED: That the public be excluded from this meeting during consideration of the following items on the agenda because of the likelihood of disclosure of “exempt information” which falls within one or more descriptive category or categories of the Local Government Act 1972, Schedule 12A, as specified.

TRAFFORD PRIVATE HIRE DRIVER - CONVICTIONS WHICH EXCEED THE SCHEME OF DELEGATION

To consider a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report requesting Members to consider a Private Hire driver’s offence.

 

The driver attended the meeting to enable Members to give the matter their full consideration.

 

The driver gave his version of the offence and answered questions from members of the Sub-Committee.

 

The Sub-Committee considered the report and the evidence given at the meeting and concluded that the driver was not a fit and proper person to hold a Private Hire driver’s licence.

 

RESOLVED: That Mr. S. A’s Private Hire driver’s licence be revoked.

 

32.

TRAFFORD PRIVATE HIRE DRIVER - CONVICTION WHICH EXCEEDS THE SCHEME OF DELEGATION

To consider a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report requesting members to consider an application to renew a Private Hire driver’s licence which disclosed a conviction.

 

The driver attended the meeting to enable Members to give the matter their full consideration.

 

The driver’s representative made representations on behalf of the driver.

 

The Sub-Committee considered the report and the evidence given at the meeting and concluded that the driver was still a fit and proper person to hold a Private Hire driver’s licence.

 

RESOLVED -

 

(1)          That Mr. B. N’s Private Hire driver’s licence be renewed.

 

(2)          That 25 penalty points be issued to Mr B. N under the Council’s Penalty Point Scheme for his failure to notify his change of address.

 

(3)          That 75 penalty points be issued to Mr. B. N under the Council’s Penalty Point Scheme for his failure to disclose a conviction.

TRAFFORD PRIVATE HIRE DRIVER - CONVICTION WHICH EXCEEDS THE SCHEME OF DELEGATION - DECISION DEFERRED FROM PREVIOUS MEETING ON 23RD JANUARY 2020

To consider a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report requesting Members to consider a Members to consider a Private Hire and Hackney Carriage driver’s offence.

 

The matter had been deferred from the last meeting to enable officers to obtain the booking records from the driver’s operator and also to allow the driver to provide evidence of the booking.

 

The driver attended the meeting to enable Members to give the matter their full consideration.

 

The Sub-Committee considered the report and the evidence given at the meeting and concluded that the driver was no longer a fit and proper person to hold either a Private Hire driver’s licence or a Hackney Carriage driver’s licence.

 

RESOLVED: That Mr. I. M. B’s Private Hire and Hackney Carriage driver’s licences be revoked.

UPDATE REPORT FOLLOWING EMERGENCY DECISION BY THE CORPORATE DIRECTOR, FOR GOVERNANCE AND COMMUNITY STRATEGY IN CONSULTATION WITH THE CHAIR, VICE CHAIR AND OPPOSITION SPOKESPERSON

To note a report of the Head of Regulatory Servcies.

Minutes:

The Head of Regulatory Services submitted a report informing Members of an emergency decision taken by the Corporate Director for Governance and Community Strategy in consultation with the Chair, Vice Chair and Opposition Spokesperson of the Sub-Committee regarding a Hackney Carriage/Private Hire driver and a complaint received about him.

 

The decision was that he was no longer a fit and proper person to hold either a hackney carriage or private hire driver’s badge and his licences were revoked with immediate effect in the interests of public safety.

 

RESOLVED: That the report be noted.

To note a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report informing Members of an emergency decision taken by the Corporate Director for Governance and Community Strategy in consultation with the Chair, Vice Chair and Opposition Spokesperson of the Sub-Committee regarding a Private Hire driver and complaints received about him.
