APPLICATION FOR THE GRANT OF A VARIATION TO THE PREMISES LICENCE - HALE COUNTRY CLUB, 47 CLAY LANE, HALE, CHESHIRE WA15 7AF (DEFERRED FROM 13/11/2017)

To consider the attached report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report informing Members of an application received from Eversheds Sutherland Solicitors for the grant of a variation to the premises licence for Hale Country Club, 47 Clay Lane, Hale, WA15 7AF which had been deferred from 13th November 2017 and had attracted an objection from the Pollution and Housing Team, Trafford Council against the application.

 

All parties present at the hearing were invited to address the Sub-Committee.

 

Representations were made in support of the application by Mr. G. Hill, Hut Group and against the application by officers of the Environmental Pollution Team.

 

RESOLVED –

 

(1)          That the application by Eversheds Sutherland Solicitors for a variation of the Premises Licence for Hale Country Club, 47 Clay Lane, Hale, WA15 7AF be granted, subject to compliance with the conditions outlined in the decision notice.

 

(2)          That the issue of the Licence be delegated to the Head of Regulatory Services.

LICENSING SUB-COMMITTEE DECISION

 

The Sub-Committee decided that the representation received from Environmental Pollution is a relevant representation.

 

To grant a variation of a premises licence as follows:-

 

Licensable Activites

 

Live Music / Performance of Films / Performance of Dance & similar entertainment

 

Monday to Sunday                             10.00 to Midnight

 

That all the above activities be extended outside the premises to include the external area shown on the attached plan.  The licence would permit the provision of licensable activities within the external area on no more than 10 occasions per calendar year.

 

 

Conditions

 

All external doors and windows shall be kept closed when regulated entertainment is being provided inside the premises except in the event of an emergency.

 

In respect of Outside Events:

 

There would be a maximum of six outside events per annum (only 2 allowed per calendar month) between the hours of 10:00 and midnight; and

A maximum of four further outside events between the hours of 10:00 and 19:00;

 

The Premises Licence holder will have at least one sound engineer in attendance at every event.  The sound engineer will monitor noise levels from the event at frequent intervals;

 

The Premises Licence holder will only use audio systems that have been designed to distribute audio evenly across the event allowing us to keep noise levels to a minimum;

 

There will be a security team in place for all events.  The security team will manage attendees and ensure they arrive and depart in a manner which causes minimum disruption to neighbours;

 

The Premises Licence holder will provide Environmental Health with a contact number of a representative of its house security team that will have responsibility for ensuring noise levels at any events are controlled

 

 

LICENSING SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION

 

The Sub-Committee considered the Licensing Act 2003 and regulations, the Guidance and the Council’s Licensing Policy and the application.

 

The Sub-Committee carefully considered the concerns raised by Environmental Pollution regarding public nuisance and balanced those concerns with the interests of the applicant and the licensing objectives.
