To consider a report of the Head of Regulatory Services.
Minutes:
The Head of Regulatory Services submitted a report informing Members of an application received from TLT Solicitors acting on behalf of Green King Retailing Ltd for the grant of a variation to the premises licence for Brooklands Tap, Hope Road, sale, M33 3YA which had attracted representations from local residents and a ward Councillor against the application.
All parties present at the hearing were invited to address the Sub-Committee.
Representations were made in support of the application by Mr. L. Elford, TLT Solicitors and against the application by Councillor B. Brotherton.
RESOLVED –
(1) That the application by Eversheds Sutherland Solicitors for the variation to the Premises Licence for Brooklands Tap, Hope Road, Sale be granted, subject to compliance with the conditions outlined in the decision notice.
(2) That the issue of the Licence be delegated to the Head of Regulatory Services.

LICENSING SUB-COMMITTEE DECISION
The Sub-Committee decided that the representations received from Local Residents and a Ward Councillor are relevant representations.
To grant a variation of the premises licence as follows:

Thursday 11:00 hrs to 11:30 hrs
Sale of Alcohol
Thursday 11:00 hrs to Midnight
Friday and Saturday 11:00 hrs to 01:00 hrs
AND Extend the Opening Hours of the premises as follows:
Thursday 11:00 hrs to 12:30 hrs
Friday and Saturday 11:00 hrs to 01:30 hrs
Additional Conditions
An incident and refusals log (‘the log’) will be kept and maintained at the premises and all incidents and refusals of sales of alcohol shall be recorded in it. As a minimum, the log will record the date and time of the incident/refusal, the name of the person making the entry, the nature of the incident/refusal and any actions taken.
Children are to be supervised by a responsible adult at all times.
Children shall not be permitted on the premises after 20:00 hrs unless taking part in a function or table meal, when they shall be permitted to remain on the premises until the end of that meal or function.
CCTV system will be installed and maintained at the premises.
CCTV will be stored for 31 days and recordings made available for the Police upon request.
Noise checks will be carried out at the boundary of the premises when regulated entertainment is provided. The details of checks completed, the findings and any action taken, if required, will be recorded.
The premises will operate a ‘Challenge 21’ Policy.
All staff will be trained in the following:
a) Challenge 21 Policy
b) The premises licence and its condition
c) A record shall be kept of this training which will be refreshed no less than every 6 months and this record shall be available for inspection by the Licensing Authority or Police upon request.
As the above conditions have been imposed it is agreed that the existing conditions 6 and 8 be removed from the licence.
LICENSING SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION
The Sub-Committee considered the Licensing Act 2003 and regulations, the Guidance and the Council’s Licensing Policy and the application.
The Sub-Committee carefully considered the concerns raised by local residents and a ward councillor regarding public nuisance and balanced those concerns with the interests of the applicant and the licensing objectives.
The Sub-Committee noted the willingness of the Licensee to work with and maintain good relations with local residents.
