APPLICATION FOR THE GRANT OF A PREMISES LICENCE UNDER S17 LICENSING ACT 2003 AT OLD HALL ROAD, SALE, M33 2GS.

To consider a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report informing Members of an application for the grant of a premises licence for Verastar Limited, 1 Dovecote, Old Hall Road, Sale M33 2GS which had attracted representations from local residents against the grant of a licence.

 

All parties present at the hearing were invited to address the Sub-Committee.

 

Representations were made in support of the application by Ms J Sutton, and Mr D Crank, Solicitor DWF Law on behalf of Verastar Limited. Representations were made against the application by Mr & Mrs McConville, Mr & Mrs Mottram, local residents and Ward Councillor J. Bennett on behalf of local residents.

 

RESOLVED –

 

(1)          That the application by Ms J Sutton for a grant of a premises licence for Verastar Limited be granted subject to compliance with the conditions outlined in the decision notice.

 

(2)          That the issue of the Licence be delegated to the Head of Regulatory Services.

LICENSING SUB-COMMITTEE DECISION

 

The Sub-Committee decided that the representations received from local residents are relevant representations.

 

To grant a premises licence for Verastar Limited as follows:-

 

Licensable Activities

 

Supply of Alcohol (both on and off sales)

Monday to Friday                             17:30 hrs to 22:00 hrs

 

Premises Opening Hours

Monday to Friday                             07:00 hrs to 22:30 hrs

 

Conditions

Any mandatory conditions which must be included under the Licensing Act 2003.

 

Additional Conditions

 

The CCTV system shall continually record and be fully operational whilst the premise is open for licensable activities and during all times when customers remain on the premises.  All recordings shall be stored and kept available and unedited for a minimum of 31 days with date and time stamping.  Recordings

shall be made available immediately upon the request of Police or authorised officer throughout the 31 day period in accordance with the Data Protection Act 2018.

 

Access to the area is for staff and invited guests who would be either members of the family of customers and supplies but would always be invited guests.

 

The Provision of off sales is to permit alcohol purchased to be taken into any external area’s that is permitted by the landlord or within the offices of the applicant company but is not the intention to permit off sales to be taken off the site.

 

If external areas are used then non glass items would be used as receptacles for drinking.

 

Public safety of the premises would be operated in accordance with current Health and Safety and Fire Safety Requirements and Regulations.

 

The premises will be operated in such a way not to cause nuisance to any nearby properties.

 

Any children who attend the premises will be accompanied by their parents if a family event is arranged.

 

Individuals who will serve alcohol will be instructed to operate a Minimum Challenge 21 policy, meaning that any person who appears to be under the age of 21 will be required to produce photo ID to prove that they are over the age of 18 and entitled to purchase alcohol.

 

Signage will be displayed near the doors requesting customers to leave the premises quietly and to be respectful of neighbours when customers are outside of the premises.

 

A company contact name and telephone number will be provided to the nearby residents, including those on Rutland Lane and Lincoln Grove so that they can contact the premises if there are any concerns.

 

Live or recorded amplified music will not be played in any external area and if music is played internally, doors and windows will be closed save to allow access and egress to the premises.

 

 

LICENSING SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION

 

The Sub-Committee considered the Licensing Act 2003 and regulations, the Guidance and the Council’s Licensing Policy and the application.

 

The Sub-Committee considered the representations received from local residents.

 

The Sub-Committee noted that no representations had been received from the Responsible Authorities.

 

The Sub-Committee carefully considered the concerns raised regarding public nuisance and balanced those concerns with the interests of the applicant and the licensing objectives.

 

The Sub-Committee considered the impact of the licensing hours requested by the Applicant on the immediate neighbours of the premises; including increased traffic, noise disturbance and consumption of alcohol.

 

The Sub-Committee agreed to add the additional conditions proposed by the Applicant to address the concerns raised by the residents.
