APPLICATION TO VARY A PREMISES LICENCE UNDER S34 OF THE LICENSING ACT 2003 AT SILVER BLADES ICE RINK, STATION SITE, OAKFIELD ROAD/MOSS LANE, ALTRINCHAM, CHESHIRE WA14 1BA

To consider a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report informing Members of an application for the grant of a full variation of the premises licence for Silver Blades Ice Rink, Station Site, Oakfield Road/Moss Lane, Altrincham, WA14 1BA which had attracted a representation from a local resident against the variation of a licence.

 

All parties present at the hearing were invited to address the Sub-Committee.

 

Representations were made in support of the application by Mr. V. Neil on behalf of Silver Blades Ice Rink Company (Altrincham) Limited and Mr. B. Arjomamd, Event Organiser.  Representations were made against the application by The Honourable S. E. Walmsley.

 

RESOLVED –

 

(1)          That the application by Mr. V. Neil on behalf of Silver Blades ice Rink Company (Altrincham) Limited for a variation of the premises licence for Silver Blades Ice Rink be granted subject to compliance with the conditions outlined in the decision notice.

 

(2)          That the issue of the Licence be delegated to the Head of Regulatory Services.

Conditions

 

Any mandatory conditions which must be included under the Licensing Act 2003.

 

Additional Conditions

 

1.    Noise from music and associated sources (including DJ’s and amplified voices) must not be audible to such an extent that it constitutes a nuisance at any noise sensitive properties.

 

2. Acoustic consultants shall be employed to monitor noise relating to the event and associated activities to comply with the above condition.

 

3. A noise management plan shall be submitted for approval. 14 days prior to the event to demonstrate how noise associated with the event will be managed (to include proposals for monitoring noise relating to the event, noise from traffic/public arriving at/leaving the venue, measure to address noise from plant and vehicles relating to the event set up, letter drop to local residents, action phone line in the event of complaints including plans for corrective action, noise from staff and any other noise associated with the event) and Stewards to be placed on exit points to aid an orderly dispersal.

 

4. All external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency.

 

5. There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, (or member and their guests) notices requiring customers to leave the premises and the area quietly. (Note, this may also include a reference to vehicles).

 

6. There shall be public announcements and messages on the big screen at regular intervals reminding customers to leave the premises and area quietly.

 

LICENSING SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION

 

1.    The Sub-Committee considered the Licensing Act 2003 and regulations, the Guidance and the Council’s Licensing Policy and the application.

 

2.    The Sub-Committee carefully considered the concerns raised by a local resident and balanced those concerns with the interests of the applicant and the licensing objectives.

 

3.    The Sub-Committee considered that the additional conditions agreed are appropriate and proportionate to the promotion of the licensing objectives.

 

4.    The Sub-Committee considered the impact of the licensing hours requested by the Applicant on the immediate neighbours of the premises; including increased traffic, noise disturbance and consumption of alcohol.

 

5.    The Sub-Committee considered the information which was supplied by the Applicant to address the concerns raised by the representor.
