APPLICATION FOR THE GRANT OF A NEW PREMISES LICENCE UNDER S17 LICENSING ACT 2003 AT DIXY CHICKEN, 912 CHESTER ROAD, STRETFORD, M32 0TH

To consider a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report informing Members of an application for the grant of a premises licence for Dixy Chicken, 912 Chester Road, Stretford M32 0PA which had attracted representations from local residents against the grant of a licence.

 

All parties present at the hearing were invited to address the Sub-Committee.

 

Representations were made in support of the application by Mr A Mahmood on behalf of Mr Sethi Limited. Representations were made against the application by, Ward Councillor M. Cordingley on behalf of local residents, Greater Manchester Police and the Licensing Authority as responsible authorities.

 

RESOLVED –

 

(1)          That the application by Mr Sethi Limited for a grant of a premises licence for Dixy Chicken be granted subject to the withdrawal of the application for alcohol sales and in compliance with the conditions outlined in the decision notice.

 

(2)          That the issue of the Licence be delegated to the Head of Regulatory Services.

LICENSING SUB-COMMITTEE DECISION

 

That the representations received from Local Residents, Ward Councillor, Greater Manchester Police and the Licensing Authority were relevant representations.

 

The Sub-Committee’s decision is to grant a premises licence for late night refreshment as follows:-

 

Late Night Refreshment    

Monday to Sunday                          23:00 to 02:30

 

 

Conditions

 

Any mandatory conditions which must be included under the Licensing Act 2003.

 

Additional Conditions

 

1.    A CCTV system will be maintained and operated at the premises with cameras positioned both internally and externally.

2.    Recorded CCTV images will be maintained and stored for a period of twenty-eight days and shall be produced to the Police or Licensing Authority upon request.

3.    CCTV will be in operation at any time a person is in the premises.  Where CCTV is recorded onto a hard drive system, any DVDs subsequently produced will be in a format so it can be played back on a standard PC or DVD player.

4.    Any person left in charge of the premises must be trained in the use of any such CCTV equipment, and be able to produce CCTV images to an officer from a responsible authority upon request.

5.    All staff will be trained in firefighting equipment.

6.    Fire risk assessments will be carried out on a regular basis.  Fire alarm tests will be carried out regularly.

7.    Fire escape doors will be monitored so that they are not blocked.

8.    Proper internal and external lighting will be provided.

9.    Any litter left directly outside the premises will be removed accordingly.

10.The emptying of bins into skips, and refuse collections will not take place between 11pm and 8am.

11.All signs of disturbance will be reported to the police immediately.

12.A first aid box will be available at the premises at all times.

13.No noise will emanate from the premises nor vibration be transmitted through the structure of the premises which gives rise to a nuisance.

14.The exterior of the building shall be cleared of litter at regular intervals.

15.Notices will be positioned at the exits to the building requesting customers to leave in a quiet manner.

16.No under 18’s (accompanied or otherwise) are to be on the premises from 22:30 until opening hours the following day.

 

 

LICENSING SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION

 

1.    The Sub-Committee considered the Licensing Act 2003 and regulations, the Guidance and the Council’s Licensing Policy and the application.

 

2.    The Sub-Committee considered the concerns raised by Local Residents, and Ward Councillor.

 

3.    The Sub-Committee also considered the concerns raised by the Responsible Authorities that is Greater Manchester Police and the Licensing Authority.

 

4.    The Sub-Committee carefully considered the licensing objectives of prevention of crime and disorder, prevention of public nuisance and protection of children from harm.

 

5.    Following discussions during the committee hearing, the applicant made the decision to withdraw their application for alcohol sales. As a result of this Greater Manchester Police withdrew their objections to the application.

 

6.    The sub-committee considered concerns raised by the Licensing Authority in relation to safeguarding issues, specifically, children being in the premises late at night. The applicant agreed to prohibit children on the premises from 22:30hrs each night. The applicant advised staff will ask for identification and challenge any individual who appears under the age of 21.
