APPLICATION FOR THE GRANT OF A NEW PREMISES LICENCE UNDER S17 LICENSING ACT 2003 AT SYD'S CHICKEN AND PIZZA, 680 CHESTER ROAD, STRETFORD, M32 0SF.

To consider a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report informing Members of an application for the grant of a premises licence for Syd’s Chicken and Pizza, 680 Chester Road, Stretford, M32 0SF which had attracted a representation from a local Councillor.

 

All parties present at the hearing were invited to address the Sub-Committee.

 

Representations were made in support of the application on behalf of the applicant by Mr. Irfan.  Representations were made against the application by Councillor Walsh, a local Councillor.

 

RESOLVED –

 

(1)          That the application by Mr. Musa for the grant of a premises licence for Syd’s Chicken and Pizza, 680 Chester Road, Stretford be granted subject to compliance with the conditions outlined in the decision notice.

 

(2)          That the issue of the Licence be delegated to the Head of Regulatory Services.

LICENSING SUB-COMMITTEE DECISION

 

The Sub-Committee decided that the representation received from a local Councillor was a relevant representation.

 

To grant a new premises licence as follows:-

 

Late Night Refreshment (Indoors)

Monday – Sunday               23.00 – 00.00

 

 

Opening Hours

Monday – Sunday               11.00 – 00.00

 

 

CONDITIONS

 

The premises will have CCTV at the premises and recordings will be stored for a minimum of 28 days.  These will be made available to the police and council upon request.

 

The licence holder will ensure that there are no youths loitering around the shop.

 

The premises will have a documented Duty of Care policy for managing intoxicated and vulnerable customers and dealing with incidents of harassment at the premises.

 

The licence holder will meet Health and Safety Regulations.

 

The premises will be fully compliant with the latest Covid regulations for hot food takeaways.

 

No Music will be played at the premises.

 

A direct telephone number for the duty manager must be prominently displayed where it can conveniently be read from the exterior of the premises by the public.  The telephone must be manned at all times the premises is open for licensable activities.

 

No deliveries or collections relating to licensable activities at the premises will take place between the hours of 00:00 - 11:00.

 

Delivery drivers will conduct the delivery in a manner that will not cause a noise disturbance to the occupiers of any residential properties surrounding the delivery address.  This includes the avoidance of slamming doors, playing loud music, shouting, over-revving engines and sounding horns to signal their arrival.  The driver shall turn the engine off immediately upon arrival at the delivery address and will park considerately without causing any obstruction to the highway.

 

Customers will be instructed when placing the order that they will not be able to collect the order from the vehicle.  All deliveries will only be made directly to the property address and customers will not be permitted to take orders from the vehicle.

 

The premises will provide sufficient waste bins at or near the exits, to enable the disposal of waste.

Children under 16 will not be served after 11.00pm ID will be requested.

 

No alcohol will be served on site at anytime.

 

Arrangements will be made for appropriate instruction, training and supervision of those employed or engaged to secure the protection of children from harm.

 

During the hours of operation of the premises, the licence holder shall ensure sufficient measures are in place to remove and prevent litter or waste arising or accumulating from customers in the area immediately outside the premises, and to the rear of the premises, and that these areas shall be swept and litter and sweepings collected and stored in accordance with the premise’s refuse storage arrangements by close of business.

 

 

LICENSING SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION

 

The Sub-Committee considered the Licensing Act 2003 and regulations, the Guidance and the Council’s Licensing Policy and the application, together with the information provided by all parties at the hearing.

 

The Sub-Committee carefully considered the concerns raised by a local Councillor and balanced those concerns with the interests of the applicant and the licensing objectives.  They noted that the representation from Environmental Health had been withdrawn after the applicant had agreed to amended hours and that any provision for outdoor Late Night Refreshment be removed from the Licence.

 

The Sub-Committee was satisfied that the statutory requirements regarding notices, advertisements and time limits had been complied with.

 

The Sub-Committee noted that the concerns raised by a local Councillor were on the grounds of public nuisance as the concerns regarded litter and noise from customers at the premises and deliveries to the premises.

 

The Sub-Committee noted that the applicant had included a number of additional measures on the operating schedule to illustrate how they propose to promote the four licensing objectives.  The Sub-Committee felt that the conditions the Applicant had proposed, together with the amendments agreed in consultation with the Council’s Environmental Health Officer, were adequate to satisfy the local Councillor’s concerns in relation to public nuisance caused by noise.

 

An additional condition was imposed by the Sub-Committee to satisfy any concerns in respect of potential littering.
