RESOLVED: That the minutes of the meeting held on 29 June 2023 be agreed as an accurate record and signed by the Chair.

EXCLUSION RESOLUTION (REMAINING ITEMS)

Motion (Which may be amended as Members think fit):

 

That the public be excluded from this meeting during consideration of the remaining items on the agenda, because of the likelihood of disclosure of “exempt information” which falls within one or more descriptive category or categories of the Local Government Act 1972, Schedule 12A, as amended by The Local Government (Access to Information) (Variation) Order 2006, and specified on the agenda item or report relating to each such item respectively.

RESOLVED: That the public be excluded because of the likelihood of disclosure of “exempt information” which falls within one or more descriptive category or categories of the Local Government Act 1972, Schedule 12A, as amended by the Local Government (Access to Inofrmation) (Variation) Order 2006, as specified on the agenda item or report relating to such item respectively.

16.

Hackney Carriage and Private Hire Driver - Alleged Fraud by Abuse of position, contrary to Section 4 of the Fraud Act 2006

To consider a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report requesting members to consider a Hackney Carriage and Private Hire driver’s licences following a complaint.

 

The Sub-Committee considered the report and the evidence given at the meeting and concluded that the driver was no longer a fit and proper person to hold both a Hackney Carriage driver’s licence and a Private Hire driver’s licence.

 

RESOLVED: That Mr. P N D’s Hackney Carriage and Private Hire driver’s licences be revoked with immediate effect in the interest of public safety.

APPLICATION FOR THE GRANT OF A NEW PRIVATE HIRE DRIVER'S LICENCE

To consider a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report requesting members to consider an application for the grant of a Private Hire driver’s licence.

 

The applicant attended the meeting to enable members to give the matter their full consideration.

 

The applicant answered questions from members of the Sub-Committee.

 

The Sub-Committee considered the report and the evidence given at the meeting and concluded that the applicant was not a fit and proper person to hold a Private Hire driver’s licence.

 

RESOLVED: That Mr. T. M’s application for a Private Hire driver’s licence be refused.

18.

DECLARATION OF A MAJOR TRAFFICING OFFENCE MID-LICENCE - PRIVATE HIRE DRIVER'S LICENCE

To consider a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report requesting members to consider a Private Hire driver’s licence where an offence had occurred mid-licence.

 

The driver attended the meeting to enable members to give the matter their full consideration.

 

The driver answered questions from members of the Sub-Committee.

 

The Sub-Committee considered the report and the evidence given at the meeting and concluded that the driver was still a fit and proper person to hold a Private Hire driver’s licence.

 

          RESOLVED: That no further action be taken against Mr. A A.

19.

UPDATE REPORT FOLLOWING EMERGENCY DECISION BY THE CORPORATE DIRECTOR, FOR PLACE IN CONSULATION WITH THE CHAIR, VICE CHAIR AND OPPOSITION SPOKESPERSON

To note a report of the Head of Regulatory Services.

Minutes:

The Head of Regulatory Services submitted a report updating members of the Sub-Committee of an emergency decision taken by the Corporate Director for Place in consultation with the Chair, Vice-Chair and Opposition Spokesperson of the Sub-Committee following information received from Greater Manchester Police in relation to a Private Hire driver.

 

          RESOLVED: That the report be noted.
