To consider a report of the Head of Regulatory Services.

The Sub-Committee was advised that the applicants wrote to the Licensing Officer on the 7^th June 2024 stating that they “would not perform the conditions that Environmental Health had proposed”. The Applicant went on to state in a later email of the same date that they would not be attending the hearing but wished the application to continue.

The Sub-Committee was advised that there had been acoustic assessment that had been disclosed to Environmental Health that indicated that further work and / or assessments may be needed. The Sub-Committee determined that it would not be in the interests of the Applicant or the matter overall to determine the application in the absence of the Applicant.

RESOLVED: That the meeting be adjourned until the 5^th September 2024 pursuant to rule 20(2)(a) of the Licensing Act 2003 (Hearings) Regulations 2005 when further consideration will be given to the application unless the objection or the application is withdrawn prior to that hearing date.
