The Head of Regulatory Services submitted a report informing Members of objections from Greater Manchester Police and Environmental Health to Temporary Event Notices issued for Station Bar and Grill, 25-29 Station Road, Urmston, M41 9JG.

 

All parties present at the hearing were invited to address the Sub-Committee.

Representations were made against the objections by Mr. M. Keskin, Designated Premises Supervisor and in support of the objections by P.C. K Packer, Greater Manchester Police and Mr. R. Pollitt, Environmental Health.

 

RESOLVED –

 

(1)          That the objection notice dated 5th December 2018 be accepted as outlined in the decision notice below.

(2)          That a Counter Notice to the Temporary Event Notices be issued.

LICENSING SUB-COMMITTEE DECISION

 

The Sub Committee have considered the licensing objectives, including the prevention of public nuisance objective and they accept the police objection notice(s) & the Environmental Health objection to the Temporary Event Notice(s) dated 3rd December 2018.

 

The reason for Sub Committee’s decision is that there was substantial evidence presented by GMP and the Environmental Health Team to demonstrate that there have been a significant number of complaints relating to the premises which have caused a significant public nuisance. The Sub Committee felt that the Temporary Event Notices would likely cause further public nuisance.

 

The Sub Committee have therefore determined to issue a counter notice to the Temporary Event Notice(s) pursuant to section 105 of the Licensing Act 2003.

 

 

SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION

 

The Sub Committee have considered the grounds of the Police Objection Notice(s) & the Environmental Health objection and the nature of the event(s) as outlined in the Temporary Event Notice(s).

 

The promotion of the prevention of public nuisance objective has been considered.

 

The Sub Committee noted the police concerns regarding numerous complaints that have been received and are continuing to be received by Greater Manchester Police in respect of:

noise nuisance from the premises and

unofficial closing time of 2.00 a.m.

 

Having considered the evidence the Sub Committee consider that it is necessary for the promotion of the prevention of public nuisance objective to issue a Counter Notice.
