To consider a report of the Head of Public Protection.
Minutes:
The Head of Public Protection submitted a report informing Members of an application received from Mr. Mark Stephen Dale for the grant of a Premises Licence for 28 Greenwood Street, Altrincham which had attracted representations from both local residents and local businesses for and against the application.
All parties present at the hearing were invited to address the Sub-Committee.
Representations were made in support of the application by the Applicant and by Mr. M. Hart and Ms. A. Ohri. Representations were made against the application by Mr. C. Hawley, on behalf of Ms. A. Hawley.
RESOLVED –
(1) That the application by Mr. Mark Stephen Dale for a Premises Licence for 28 Greenwood Street, Altrincham be granted, subject to compliance with the conditions outlined in the decision notice below.
(2) That the issue of the Licence be delegated to the Head of Public Protection.

LICENSING SUB-COMMITTEE DECISION
The Sub-Committee decided that the representations from local residents were from interested parties living in the vicinity of the premises.
The Sub-Committee decided that the representations relating to prevention of public nuisance, crime and disorder and public safety were relevant representations.
To grant a premises licence as follows:

Non-Standard Timings for all Licensable Activities
An additional hour for all Public and Bank Holidays (Sunday to Monday inclusive)
Conditions
Mandatory Conditions under section 19 and 19A of the Licensing Act 2003 where the licence authorises the supply of alcohol off the premises.
PPN3
Noise from music and associated sources (including DJ’s and amplified voices) must not be audible to such an extent that it constitutes a nuisance at any noise sensitive properties.
PPN4
All external doors and windows shall be kept closed when regulated entertainment with amplified sound is being provided after 9.00 p.m. except in the event of an emergency.
PPN6
There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public (or member and their guests) notices requiring customers to leave the premises and the area quietly. (Note, this may also include a reference to vehicles).
The applicant also agreed to the following conditions:-
1. To provide door staff at the premises every Friday and Saturday evening from 9.00 p.m.
2. To a daily clean of the smoking area and external frontage.
3. To install air conditioning with exterior air conditioning units being contained in an acoustic enclosure.
4. To allow an assessment of the acoustic measures at the premises by an authorised officer of Trafford Council.
5. No children shall be allowed on the premises after 9.00 p.m.
6. A challenge 25 will be used when serving alcohol and photo identification will be required to prove customers age.
LICENSING SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION
The Sub-Committee considered the Licensing Act 2003 and regulations, the Guidance and the Council’s Licensing Policy, the application and all representations made.
The Sub-Committee considered the written representations received from local residents.
The Sub-Committee carefully considered the resident’s concerns regarding the potential for public nuisance, crime and disorder and public safety and balanced those concerns with the interests of the applicant and the licensing objectives.
