To consider a report of the Head of Regulatory Services.
Minutes:
The Head of Regulatory Services submitted a report advising Members of an application for the grant of a premises licence for Javes, 42-44 Brook Road, Urmston, M41 5RY, which had attracted representations from local residents both for and against the grant of a licence.
All parties present at the hearing were invited to address the Sub-Committee.
Representations were made on behalf of the applicant by Mr. Ellis, Designated Premises Supervisor and Mrs. Ellis, Director of Javes 2017 Limited and Councillor Lally, representations against the application were made by Mr. Billington.
RESOLVED –
(1) That the application by Mrs Ellis, Director of Javes 2017 Limited for the grant of a premises licence for Javes, 42-44 Brook Road, Urmston, M41 5RY be granted, subject to compliance with the conditions outlined in the decision notice.
(2) That the issue of the licence be delegated to the Head of Regulatory Services.

LICENSING SUB-COMMITTEE DECISION
The Sub-Committee decided that the representations received from local residents are relevant representations.
To grant a premises licence as follows:-
Licensable Activities
Sale of Alcohol (on the premises)
Monday to Sunday 08.00 to 22:00
Note: to cover both units at ground level and the first floor function room.
Conditions
Any mandatory conditions which must be included under the Licensing Act 2003.
Additional Conditions
The use of the external courtyard to the rear of the premises for customers shall only take place between the hours of 08:00 to 18:00.
No refuse shall be disposed of or collected and no deliveries made between the hours of midnight and 06:30 where such disposal or delivery is likely to cause disturbance to local residents.
Challenge 25
Persons who are attempting to buy alcohol who appear to be under the age of 25 years shall be required to produce proof of age by way of a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence, passport or accredited student card.
There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, (or members and their guests) notices requiring customers to leave the premises and the area quietly. (Note, this may also include a reference to vehicles).
LICENSING SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION
The Sub-Committee considered the Licensing Act 2003 and regulations, the Guidance and the Council’s Licensing Policy and the application.
The Sub-Committee considered the representations received from local residents.
The Sub-Committee noted that not all the local residents who had made written representation were able to attend this evening’s meeting.
The Sub-Committee considered the petition submitted supporting the application.
The Sub-Committee carefully considered the resident’s concerns regarding public nuisance and balanced those concerns with the interests of the applicant and the licensing objectives.
