To consider a report of the Head of Regulatory Services.

The Head of Regulatory Services submitted a report informing Members of an objection from Environmental Health to a Temporary Event Notice issued for

Archway 1, Pomona Strand, Old Trafford, M16 0TT

All parties present at the hearing were invited to address the Sub-Committee.

Representations were made against the objection by Mr. O. Ryder, the Applicant and in support of the objection by Ms A. Pollitt, Environmental Health.

RESOLVED –

(1)    That the objection notice dated 15^th July 2020 be accepted as outlined in the decision notice below.

(2)   That a Counter Notice to the Temporary Event Notice be issued.

LICENSING SUB-COMMITTEE DECISION

The Sub Committee have considered the four licensing objectives - the prevention of public nuisance, the prevention of crime and disorder, the protection of children from harm and public safety and they accept the Environmental Health objection to the Temporary Event Notice dated 15^th July 2020.

The Sub Committee have therefore determined to issue a counter notice to the Temporary Event Notice pursuant to section 105 of the Licensing Act 2003.

SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION

The Sub Committee considered the grounds of the Environmental Health representation and the nature of the event as outlined in the Temporary Event Notice together with the information provided by the applicant at the hearing.

Having considered the evidence, the Sub Committee consider that it is necessary for the promotion of the licensing objectives to issue a Counter Notice.

The Sub-Committee heard from the applicant, Mr Ryder, and the representative for the Environmental Health team, Ms Pollitt.

Ms Pollitt explained the importance of businesses following the Governments Covid Secure Guidance to ensure safety for customers and guests during the Coronavirus pandemic. Concerns were raised about the lack of detail within the risk assessment submitted by the applicant. The Sub-Committee felt that the risk assessment lacked detail, particularly information around cleaning and sanitization of the venue and how the applicant could sufficiently mitigate any risks associated with Coronavirus. The applicant confirmed that guests would not have access to running water for cleaning hands. The Sub-Committee were of the view that the cleaning of the toilets and guest areas was felt to be insufficient.

The Sub-Committee also raised concerns over social distancing within the venue and guests not having access to table service.

The Sub-Committee felt that the risk assessment and event plans did not meet the standard required under the Covid Secure Guidance, public safety would be at risk and the information provided did not satisfy them that the licensing objectives would be promoted.
