Notice of Urgent Key Decision Taken Without 28-Day Notice
Notice is hereby given in accordance with Regulation 10 of the Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012 that it was impracticable to give 28 days’ notice of the taking of the following decision, which is a Key Decision taken under delegated authority by the Leader of the Council, on 8th January 2022:
Urgent Measures in relation to the Council’s duties under the Care Act 2014
Notice is further given in accordance with Regulation 11 of the Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012 that the same decision was taken on the basis of urgency, and was therefore subject to the provisions of Regulation 11.(1). In accordance with these Regulations, the Chair of the Scrutiny Committee has been advised of this issue, and has agreed that the making of the decision is urgent and cannot reasonably be deferred, for the following reason:
The current pressures on the Council arising as a result of the situation in relation to health and social care provision are extensive and the impact of those pressures is causing concern around the ability of the Council to discharge its statutory duties in accordance with the Care Act 2014. The position is such that the Council needs to be in a position where it has in place an approved contingency plan which would then enable it to reach speedy decisions around the implementation of agreed urgent measures if the situation reaches a critical point.
The need in that regard is urgent such that a decision on the measures proposed cannot reasonably be deferred to enable formal advance notice of the decision to be given and it will need to be implemented immediately.
