APPLICATION FOR THE GRANT OF A PREMISES LICENCE – p&h convenience store, 26 carrington road, flixton, m41 6hx

 

The Head of Public Protection submitted a report informing Members of an application received from Mr. P Haider for the grant of a premises licence for P&H Convenience Store, 26 Carrington Road, Flixton, which had attracted representations from local residents.

 

Representations were made in support of the application by Mr. R. Williams, Solicitor on behalf of the applicant and Mr. P Haider, the applicant.

 

           RESOLVED –

 

(1)       That the application by Mr. P Haider for a Premises Licence for P&H Convenience Store, 26 Carrington Road, Flixton, be granted, subject to compliance with the conditions outlined in the decision notice.

 

(2)       That the issue of the Licence be delegated to the Head of Public Protection.

LICENSING SUB-COMMITTEE DECISION

 

The Sub-Committee decided that the representations from local residents were from interested parties living in the vicinity of the premises.

 

The Sub-Committee decided that those representations relating to noise nuisance and anti-social behavior were relevant representations.  The representations relating to road safety, parking and the number of licensed premises in the area were not relevant representations.

 

To grant a premises licence as follows:

Sale by retail of alcohol for consumption OFF the premises:

 

Monday to Sunday                    07.00 – 22.30

 

 

Conditions

 

Mandatory Conditions under section 19 and 19A of the Licensing Act 2003 where the licence authorises the supply of alcohol off the premises.

 

 

LICENSING SUB-COMMITTEE’S REASONS FOR REACHING ITS DECISION

 

The Sub-Committee considered the Licensing Act 2003 and regulations, the Guidance and the Council’s Licensing Policy, the application and all representations made.

 

The Sub-Committee considered the written representations received from local residents in the absence of their attendance at the meeting.

 

The Sub-Committee noted the absence of other representations about this application apart from the objection received from three local residents.

 

The public safety objective is concerned with the physical safety of people on the premises and not with road safety issues.

 

The area is not within one of the two areas of cumulative impact within Trafford, and therefore the number of licensed premises in the area is not a relevant consideration.

 

The Sub-Committee carefully considered the resident’s concerns regarding the potential for noise nuisance and anti-social behaviour and balanced those concerns with the interests of the applicant and the licensing objectives.
