Notice of Intention to take Key Decision without 28-Day Notice

Notice is hereby given in accordance with Regulation 10 of the Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012 that it was impracticable to give 28 days’ notice of the taking of the following decision, which is a Key Decision to be taken by the Executive at its meeting on 21st March 2022:

·         Care Act 2014 – Urgent Measures Decision Framework

The reason for which it has been impracticable to give 28 days’ notice of this decision is as follows:

In accordance with the previous decision, a review of the contingency framework based on an assessment of need was commenced during the week commencing 7 February 2022. The circumstances of the social care sector are complex, with demand varying from day to day. In order to complete a robust review and to determine whether a contingency framework is needed going forward or not, evidence needed to be collated and extensive work with providers was necessary to assess, understand and identify pressures and potential areas of risk. In this respect the review has taken some time to conclude which meant that the Council was unable to determine whether a key decision would be necessary within the 28 day notice period. In addition, the Government’s announcement on restrictions, made during the week of the 21 February, was also considered as part of the review process with a view to understanding the potential impact on the care sector.

The Chair of the Scrutiny Committee has been advised of this issue in accordance with Regulation 10.
